‘Shameful’: Judge stuns state with order that ‘noncitizens’ be put BACK ON voter rolls.

In the military we were read the Punitive Articles of War, now called the Uniform Code of Military Justice (UCMJ). It outlined the penalties for disobedience, which ranged up to death in wartime. But it added that we were not just permitted, but required, to disobey an illegal order.

The My Lay massacre in Vietnam occurred when an inexperienced lieutenant ordered his men to shoot all the residents of a village. This was used as an example of an illegal order we were obligated to disobey. But what about civilian life?

Federal Law establishes citizenship as a prerequisite for voting. How this is to be proved is not stated. But ordering that non-citizens be allowed to vote is clearly an illegal order, which all of us are obligated to disobey. Judges are not the legislature. Their job is to interpret and enforce law, not to make it, and surely not to unmake it. And judges are definitely not God, empowered to change the order of nature regarding the sexes.

Non-citizens in the voting booth? Biological males in the girls’ locker room? Once we are as certain as possible that the order is illegal, we need to empower ourselves to say “NO!” Rather loudly, in fact. That’s what citizens of a constitutional republic do. Good little Nazis, not so much. They obey authority regardless. Befehl ist Befehl. An order is an order.
